This Privacy Policy explains how ModLearn (Owen Raisch d/b/a ModLearn) (“ModLearn,” “we,” “us”) collects, uses, shares, and protects information when you use our training content, learning enablement services, and software tools (collectively, the “Services”). The Services may be delivered through third-party platforms (for example, a learning management system operated by its provider), and your Employer may authorize ModLearn to administer or configure that platform on your Employer’s behalf.
If you access the Services through an organization, that organization is the ModLearn customer (“Employer”). Your Employer may have additional policies that apply to your workplace use of the Services.
1) Information We Collect
We may collect the following categories of information:
A. Account and Identity Information
Name, work email, employee ID or other identifiers your Employer provides
Role/permissions (e.g., learner, manager, admin)
B. Training and Usage Information
Course enrollments, completions, progress, quiz results/attempts, acknowledgements
Activity logs (e.g., timestamps, feature usage, content views)
Device and technical data (e.g., browser type, OS, approximate location derived from IP, user agent)
C. Communications
Messages you send to us (e.g., support requests), and our responses
D. Employer Content / Submissions
Content your Employer or its users upload or create in connection with the Services (e.g., SOPs, materials, comments), and associated metadata
E. Cookies / Similar Technologies (if applicable)
If we operate a website or software interfaces that use cookies or similar technologies, we may use them for authentication, security, and basic analytics.
2) How We Use Information
We use information to:
Provide, operate, and improve the Services
Authenticate users and administer access/roles
Deliver training and track progress/completions
Provide customer support and respond to requests
Monitor security, prevent fraud/misuse, and debug issues
Generate aggregated or de-identified analytics (e.g., overall completion rates)
Comply with legal obligations and enforce our terms
3) How We Share Information
We may share information in these situations:
A. With Your Employer
Your Employer can access information about your usage and training progress (including enrollments, completions, and results) for workforce training, compliance, and operational purposes.
B. With Service Providers
We use vendors to help run the Services (e.g., hosting, analytics, communications, customer support). They may process information on our behalf under contractual confidentiality and security obligations.
C. With Third-Party Platforms (e.g., LMS Provider)
If training is delivered through a third-party LMS or other platform, information may be processed within that platform according to the platform provider’s terms and policies and your Employer’s configuration. Your Employer may also authorize ModLearn to administer the platform on your Employer’s behalf (e.g., uploading content, configuring assignments, managing enrollments).
D. For Legal and Safety Reasons
We may disclose information if we believe it is reasonably necessary to comply with law, regulation, legal process, or governmental requests, or to protect the rights, property, and safety of ModLearn, our customers, users, or others.
E. Business Transfers
If we undergo a merger, reorganization, financing, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to a policy that continues to protect your information.
4) Data Retention
We retain information for as long as needed to provide the Services and for legitimate business purposes (e.g., audit logs, dispute resolution, security, and legal compliance). Your Employer may request deletion or export of certain data, subject to applicable law and contractual obligations.
5) Security
We implement reasonable administrative, technical, and organizational safeguards designed to protect information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
6) Your Choices and Rights
Because the Services are provided through your Employer:
For most requests (access, correction, deletion), you should contact your Employer first.
If you contact ModLearn directly, we may refer your request to your Employer or require confirmation of authorization.
California Privacy Rights (if applicable):
If ModLearn is subject to the California Consumer Privacy Act as amended by the CPRA, California residents may have rights to request access, deletion, and correction, and to opt out of certain “sales” or “sharing” of personal information. ModLearn does not sell personal information in the ordinary sense. You can submit requests using the contact information below, and we may verify your identity and/or your Employer authorization.
7) Children’s Privacy
The Services are intended for workplace users and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us and we will take appropriate steps.
8) International Use
If you access the Services from outside the United States, your information may be processed in the United States or other locations where we or our service providers operate. By using the Services, you understand that information may be transferred to these locations.
9) Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If changes are material, we may provide notice through the Services and/or require re-acknowledgement where appropriate. The “Last Updated” date indicates when it was most recently revised.
